Context
Taxpayers domiciled or established outside France who make transfers for valuable consideration in France (sales, exchanges, divisions of companies, contributions to companies, dissolutions of companies) of real estate assets or rights relating to such assets, of units in real estate investment funds, units or shares in certain real-estate companies and investment companies, may be required to appoint a tax representative to complete reporting formalities and guarantee payment of any levy due on capital gains realized on the sale.
Who's concerned?
Individuals living outside France
Individuals resident outside France who sell a property in France must appoint a tax representative when :
- They are domiciled outside the European Union and outside the European Economic Area (excluding Liechtenstein);
- The sale price of the property exceeds €150,000; and
- The property has been owned for less than 30 years.
The companies
Companies must appoint a tax representative when :
- They are headquartered outside the European Economic Area (excluding Liechtenstein);
- These are partnerships not subject to corporate income tax and headquartered in France if the partners, whether individuals or legal entities, are themselves required to appoint a tax representative in accordance with the above conditions.
What is the tax representative's role?
- It evaluates the amount of the capital gain for accounting and tax purposes generated by the sale of the property or shares in real estate companies;
- He signs the declaration of capital gains and guarantees its accuracy;
- It guarantees the tax authorities payment of taxes due and the completion of administrative formalities;
- He undertakes to pay the tax and penalties in the event of a tax reassessment.
